The parties are directed to submit briefing addressing the question whether this Court has jurisdiction to hear the appeal in light of the language in 28 U.S.C. § 1253 permitting a direct appeal "in any civil action, suit or proceeding required by any Act of Congress to be heard and determined by a district court of three judges." The briefs, not to exceed 3,000 words, are to be filed simultaneously with the Clerk and served upon opposing counsel on or before 2 p.m., Monday, March 10, 2008. Reply briefs, not to exceed 2,000 words, may be filed with the Clerk and served upon opposing counsel on or before 2 p.m., Thursday, March 13, 2008.
